1. Scope of the Terms and Conditions
We, Karlotta Pink – Fabrics from Around the World (owner since 1 March 2022: Kerstin Kroth), operate an online shop on our website for fabrics, sewing patterns and sewing kits, and also sell these products at trade fairs and events. All deliveries and services provided through this online shop and at such trade fairs and events are carried out exclusively in accordance with these Terms and Conditions in the version valid at the time the contract is concluded.
Where “written” communication is required under these Terms and Conditions, this also includes electronic communication.
2. Orders and Conclusion of Contract
Orders placed by you as an end customer:
Your order becomes binding for you as soon as you have completed it through the online shop. You will automatically receive an email confirming receipt of your order. However, this email does not yet constitute confirmation that all products included in your order are available and can be delivered. If any products are unavailable, we will inform you as soon as possible. If all products are available, no further separate confirmation will be sent and the products will be dispatched in accordance with the delivery times set out in these Terms and Conditions.
Orders placed by resellers or professional processors:
Orders must be submitted in writing by email. You will receive a pro forma invoice as an offer, listing the ordered items, delivery times and shipping costs. Acceptance of this offer must be confirmed to us in writing.
3. Prices
Prices in the online shop are stated in euros. The legally applicable value-added tax is included. Packaging and shipping costs are not included in the price.
Any customs duties or other charges incurred must be paid by you and are not included in the flat-rate shipping charge.
4. Product Information and Availability
We do not guarantee the accuracy, completeness or current validity of information regarding availability and delivery times. Product availability is checked continuously; however, individual items may already be sold out during the ordering process. In such cases, delivery may be delayed or may no longer be possible, as many products are produced or available only in small batches. We therefore cannot guarantee that products will remain available in the future.
You will be kept informed of the delivery status as soon as information regarding any delivery delays becomes available to us.
5. Payment Methods
Payment options for end customers:
- Advance payment by bank transfer: Once the payment details have been sent in the confirmation email, the goods will be reserved for 10 days. After this period, they will be released for sale again if the amount due has not been credited to the specified account.
- Advance payment via PayPal.
- Advance payment via instant bank transfer, provided this option is offered in the online shop.
- Advance payment by credit card, provided this option is offered in the online shop.
- The following payment methods are not accepted: cheques, bills of exchange and promissory notes.
Payment options for resellers or professional processors:
Payment is generally made in advance by bank transfer. The offer shown on the pro forma invoice is valid for 10 days. After this period, a new offer must be requested through the online ordering process.
Payment by invoice is only possible by prior agreement and only for subsequent orders. In such cases, the invoice is due within 10 days of the invoice date. From the due date, default interest at the statutory rate of 9% is payable without the need for a reminder. In addition to this default interest, a processing fee of €10.00 will be charged for each payment reminder and/or formal reminder. In the event of debt collection proceedings, all legal enforcement costs incurred will also be charged.
6. Packaging and Shipping Costs
Shipping is carried out by DHL or Deutsche Post.
For end customers:
To speed up the process, we offer flat-rate shipping charges based on the destination country. These include packaging costs and postage for one shipment. They do not include reshipping or return costs if a parcel is returned due to an incorrect address or because it was not collected from the post office within the applicable storage period.
We reserve the right to determine the most efficient shipping method and shipping costs at our sole discretion.
7. Delivery and Delivery Times
Goods are generally prepared for dispatch within 2 to 3 working days. If preparation for dispatch is delayed by more than 5 days in exceptional circumstances, Karlotta Pink will announce this on the homepage and/or inform the customer accordingly.
Individual delivery times will be agreed with the customer for goods that are not in stock.
8. Retention of Title
The delivered goods remain the property of Karlotta Pink until payment has been made in full.
9. Refusal of Delivery
Acceptance may not be refused:
- because of colour variations,
- because of other minor deviations from the product description,
- because the parcel was opened by customs,
- because of customs charges.
The costs resulting from an unjustified refusal to accept the delivered goods will be charged to the customer. The seller’s right to demand fulfilment of the purchase contract remains unaffected.
The goods will be deemed received and accepted no later than 25 days after dispatch, unless you have informed us that the goods have not arrived or you have submitted a complaint regarding the goods.
10. Warranty, Liability and Returns
Minor colour variations between the delivered goods and the images shown online or in brochures cannot be avoided and must be accepted by you. Such variations are unavoidable because both screen displays and printed media in which Karlotta Pink products are presented, as well as the lighting conditions under which you view the colours, cannot generally reproduce the actual colours with complete accuracy.
The goods are cut to the length or lengths requested by you. Exchanges are therefore unfortunately not possible. If the delivered goods are defective, the customer is required to notify us in writing immediately, but no later than 5 days after receipt of the goods.
Irregularities and minor printing inaccuracies must be accepted in the case of handmade or printed fabrics.
We carry out random washing tests on fabric collections in order to assess their washing behaviour. The colours of some fabrics, particularly Indian fabrics, are obtained from natural substances and do not have a chemical finish. As a result, these fabrics may continue to lose colour during subsequent washes. We accept no liability for discolouration caused by washing.
We accept no liability for:
- damage caused by improper use of the purchased items,
- damage caused by improper transport by the shipping company,
- damage caused by improper handling of the goods or unexpected reactions during the use of the fabrics, such as allergic reactions to substances used during processing, to the extent permitted by law.
We exclude liability for both ordinary and gross negligence.
Liability for intentional conduct, injury to health or body, and death is not excluded.
A right of cancellation is NOT granted.
There is NO general right of return.
For parcels returned without prior agreement, the amount due remains payable. Parcels returned without prior agreement do not constitute a cancellation.
If an item does not meet the customer’s expectations, the customer must contact Karlotta Pink in writing, preferably by email, before returning it.
According to the current state of technology, error-free and uninterrupted data communication via the internet cannot be guaranteed. We therefore accept no liability for the continuous availability of our online sales platforms.
11. Privacy Policy
Karlotta Pink treats your data confidentially and does not sell it to third parties or otherwise pass it on. The data required for processing business transactions will be stored for as long as necessary to maintain the business relationship. You may request information about the personal data stored about you at any time. You have the right to have your data deleted by us at any time. However, if you request deletion of your data during an ongoing business relationship, we cannot guarantee the proper or error-free processing of any transactions.
If your data is registered in our system, for example through an order or registration for newsletters in our online shop, your data will be used through the Mailchimp online service for the purpose of sending newsletters. Every newsletter sent in this way contains a hyperlink that allows you to unsubscribe permanently. If your order is shipped, your data, including your address, email address and telephone number, will also be passed on to DHL or Deutsche Post for processing the shipment.
This website uses Google Analytics™, a web analytics service provided by Google Inc. (“Google”). Google Analytics uses so-called “cookies”. You can prevent cookies from being installed by selecting the appropriate settings in your browser. However, please note that in this case you may not be able to use all functions of this website in full.
By using this website, you consent to the processing of data collected about you by Google in the manner and for the purposes described above.
12. Severability
If any provision or regulation of these Terms and Conditions is invalid, unlawful or unenforceable, it will be replaced by a valid, lawful and enforceable provision that comes closest to the economic purpose of the invalid, unlawful or unenforceable provision and reflects the intentions of both contracting parties.
13. Applicable Law and Place of Jurisdiction
These Terms and Conditions are governed exclusively by German law. The ordinary courts at the registered office of Karlotta Pink shall have jurisdiction over all disputes arising from or in connection with these Terms and Conditions and any additional or differing contractual agreements between Karlotta Pink and the customer.
Even in the case of contracts that predominantly have connections with a legal system other than German law, no other law shall apply and no courts other than those declared competent here shall have jurisdiction.
